Sinha graft case: HC orders 2 acquitted to surrender

High Court has issued an order for Md Shahjahan and Niranjan Chandra Saha, who were acquitted in the SK Sinha graft case, to surrender.

HC bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman issued the order on Wednesday.

Additionally, the high court has also asked why the acquittal of Shahjahan and Niranjan should not be revoked.

Earlier on Tuesday, Anti-Corruption Commission appealed against the acquittal verdict of the two in the Sinha money embezzling and laundering case.

Shahjahan and Niranjan were associates in the case filed over embezzling Tk 4 crore from Farmers Bank (current Padma Bank), and it was proved in the Judicial court, but they were still acquitted, said ACC advocate Md Khurshid Alam Khan.

"In the appeal, we said we agree with the court's statement that the two of them were not beneficiaries. But they were associates. They applied for the loan the very day that they opened bank accounts. Therefore, it was not right to acquit them," the advocate added.

On July 10, 2019, the ACC filed the case accusing the former chief justice SK Sinha and 10 others of accumulating illegal wealth and laundering Tk 4 crore.

On September 25, 2019, the anti-graft body summoned five officials of Farmers Bank Ltd for interrogation over the deposit of Tk 4 crore in SK Sinha’s account with the Supreme Court branch of Sonali Bank Ltd.

On December 10, 2019, the investigation officer of the case filed a charge sheet against the 11 accused.

On August 13, 2020, a court framed charges against the 11 including SK Sinha.

On November 9, 2021, Dhaka Special Judge Court-4 convicted and sentenced former Chief Justice Surendra Kumar (SK) Sinha to 11-year imprisonment in the case.  

The court also sentenced eight others to different jail terms in the case while Md Shahjahan and Niranjan Chandra Saha were acquitted.
