A Dhaka court on Wednesday framed charges against controversial e-commerce company Evaly’s CEO Mohammad Rassel and his wife Shamima Nasrin – chairman of the company – in a case filed on charges of embezzling customers’ money.

Metropolitan Magistrate Mehedi Hasan framed the charges against the couple and fixed February 18 to start recording testimony of prosecution witnesses in the case.

Rassel, now in jail, pleaded not guilty and demanded justice after the court read out charges to him during the charge framing. The court also issued an arrest warrant against Shamima Nasrin, as she was absent before the court, submitting a time petition through her lawyer.

The court directed officers-in-charge (OC) of Dhanmondi and Kafrul police stations to submit by February 18 the progress report on execution of the arrest warrant.

The court also discharged Md Mainul Haque, an employee of Evaly, from charges of the case as the court found no evidence to prosecute him.

The Criminal Investigation Department (CID) on August 11 submitted a charge sheet against three people, including the couple in the case.

Arif Baker – a consumer – filed the case with Gulshan police station in the capital in September last year.

According to the case statement, Arif Baker had ordered goods worth Tk 3,10,597 from Evaly in May and June after seeing attractive offers on its website on May 29 of 2021. But he did not get the products within the stipulated time.

Evaly was committed to refund the paid amount if the goods were not delivered within seven to 45 working days. But the company failed to deliver the products or refund the money, according to the case statement.
