HC stays rape case against four children

The High Court on Sunday stayed a rape case against four children from Bakerganj in Barishal.

The High Court bench of Justice Md Mozibur Rahman Miah and Justice Mohi Uddin Shamim passed the order on Sunday. The court also fixed October 22 for the next hearing on this case.

The High Court also ordered to ensure the safety of the children and their family too.

All the accused in the case are aged between 10 and 11 years.

Earlier today, Bakerganj magistrate Enayet Ullah made an unconditional apology before the court as he had violated the Children Act by sending the four children to the juvenile centre instead of handing over them to their parents.

Earlier on October 8, the same High Court bench issued the suo motu (voluntary) rule to release the children at a rare Thursday night court session, after learning of the incident through the media.

The High Court also asked the deputy commissioner of Barishal and the officer-in-charge (OC) of Bakerganj police station to make an arrangement for handing over the children to their parents.

The court also ordered the transport of the children from Jashore to Bakerganj on a microbus having air condition facilities.

The High Court also summoned senior judicial magistrate Enayet Ullah to appear before the court on Sunday (October 10) to explain why he had violated the Children Act by sending the children to the juvenile centre.

Besides, the court also asked the Bakerganj police station OC to appear before the court with the children and their parents for hearing on October 10.

The High Court asked the Barishal Medical College Hospital’s director to submit the victim’s medical report to the court on the same day.

According to the case statement, the four boys raped a six-year-old girl in the pretext of playing games on October 4.

The victim disclosed the matter to her mother after she fell sick on October 6.

The victim’s father filed a case against them at Bakerganj Police Station on October 6.
