The High Court on Wednesday handed down judgment in the favour of actor Zayed Khan paving him the way to retain the position of the general secretary of the Bangladesh Film Artists Association (BFAA).
The court said the appeal board’s cancelling Zayed Khan’s candidature and declaring actress Nipun declared general secretary of BFAA was illegal.
The bench of Justice Mamnoon Rahman and Justice Khandaker Diliruzzaman passed the order after hearing a writ petition challenging the validity of cancelling Zayed Khan’s candidature and declaring Nipun as general secretary of the association.
The court said that the decision taken by the Electoral Appellate Board on the instructions of the Ministry of Social Welfare was also illegal.
The court also issued a rule questioning why the decision of the appellate board to cancel Zayed Khan’s candidacy in the Bangladesh Film Artistes’ Association election should not be considered unconstitutional.
Meanwhile, Nipun Akter’s lawyer Mostafizur Rahman Khan said that an appeal would be lodged with the Appellate Division against the verdict.
Earlier, actor Zayed Khan filed a contempt of court case against actress Nasrin Akter Nipun for illegally holding the office of the general secretary of the BFAA.
Zayed’s candidacy was cancelled on February 5 by the election appeal board, which found that he had paid members to vote for him and had breached the electoral code of conduct.
On January 30, actress Nasrin Akter Nipun alleged that Bangladesh Film Development Corporation Managing Director Nuzhat Yeasmin, chief election commissioner of the recently held BFAA polls Pirzada Shahidul Harun and Zayed Khan formed a nexus against Kanchan-Nipun panel in the BFAA polls 2022.
In BFAA election Zayed Khan bagged 176 votes and his rival Nipun got 163 votes.
