Cricketer Shakib Al Hasan has sent legal notices to mobile telecom operator Banglalink and Jamuna Bank for illegal use of his image for advertising and claimed a compensation of Tk 5 crore 80 lakhs and 50 thousand.
On behalf of Shakib, his legal associate Alliance Laws send the legal notice on Sunday. The press release said, “On 21-1-2014, Shakib Al Hasan made a contract with Banglalink Digital Communication through which Banglalink obtained the brand image right of Shakib Al Hasan. According to the terms and conditions of the contract, Banglalink shall not be able to use any image of Shakib Al Hasan after the expiration of the contract on 20-1-2016.”
But Banglalink has been illegally using the pictures and signatures of Shakib Al Hasan inside the ATM booths of Jamuna Bank and many other places which is a clear breach of the contract. Jamuna Bank and Banglalink are also guilty of breaching the consumer rights law, digital security law, copyright law, and penal code law, the press release said.
Advocate Ashraful Hadi, attorney of Shakib, said, “After the brand ambassador agreement expired, Banglalink has been using his images and celebrity signature in the ATM booths of Jamuna Bank to gain profit. We have found evidence of using Shakib’s images and signature illegally, which is a clear breach of the agreement. We have claimed compensation of Taka 5 crore 80 lakhs and 50 thousand. At the same time, we want Banglalink and Jamuna Bank to withdraw all the images of Shakib from their holdings.”
In the legal notice, Banglalink and Jamuna Bank have been awarded a seven-day notice to pay up the compensation. Otherwise, the matters will be solved legally, said Ashraful.
“By illegal use of Shakib’s image and signature, Jamuna Bank and Banglalink have breached the digital security act, consumer rights protection act, copyright act and made a criminal breach of trust and cheating. We can file a criminal lawsuit if they don’t pay the sum and withdraw the illegal advertisements in the given time,” he told the media.
The Business Post tried to reach both Banglalink and Jamuna Bank.
Ankit Sureka, Head of Corporate Communications and Sustainability of Banglalink, said through an email, “We have not received any such notice officially yet. Therefore, we cannot comment on this.”
Sarwar Matin, SAVP at Jamuna Bank and head of brands, over the phone told The Business Post, “We are yet to receive the legal notice. I watched Shakib’s attorney talking to the media. Actually, we are a bit confused because we never had any type of commercial contract with Shakib Al Hasan. We first have to see the notice and then our legal team will work on it.”
